Dwella Inc. ("Dwella", "we", "our", or "us") operates an AI-powered HOA management platform. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our platform, website, and services (collectively, the "Services").

By accessing or using the Services, you agree to this policy. If you do not agree, please discontinue use of the Services.

Information We Collect

Account and identity information

  • Name, email address, and password when you register
  • Role (board member, resident, vendor, HOA manager, builder)
  • Community or organization name
  • Unit number and property address
  • Phone number (optional, for vendor SMS workflows)

Community and operational data

  • HOA governing documents, bylaws, CC&Rs, and rules uploaded to the platform
  • Maintenance requests, violation records, and service history
  • Dues payments, ledger entries, and financial records associated with your community
  • Meeting minutes, agenda items, and board decisions
  • Vendor information including contact details and work orders

Usage and technical data

  • Log data: IP address, browser type, pages visited, and timestamps
  • Device information: operating system and screen resolution
  • Feature usage patterns to improve the product
  • Cookies and similar tracking technologies (see Cookie section below)

How We Use Your Information

  • Provide, operate, and improve the Services
  • Process dues payments and generate financial statements
  • Send transactional emails (magic-link login, payment confirmations, violation notices)
  • Route maintenance requests and work orders to vendors
  • Power AI-assisted features including document Q&A, request classification, and workflow automation
  • Enforce community rules and compliance workflows on behalf of boards
  • Respond to support requests and troubleshoot issues
  • Send product updates and announcements (you may opt out at any time)
  • Comply with legal obligations

Sharing of Information

We do not sell your personal information. We share data only in the following circumstances:

Within your community: Board members, HOA managers, and residents see data scoped to their role and community. Vendors see only the job details routed to them.

Service providers: We use trusted third-party infrastructure providers (cloud hosting, payment processing, email delivery, analytics) under data processing agreements that restrict their use of your data.

Legal requirements: We may disclose information if required by law, subpoena, or to protect the rights and safety of Dwella, our users, or the public.

Business transfers: In the event of a merger, acquisition, or asset sale, user data may transfer to the successor entity. We will notify affected users in advance.

Data Retention

We retain your data for as long as your account is active or as needed to provide the Services. Communities that terminate their subscription may request a full data export within 30 days of termination. After that window, data is permanently deleted from production systems within 90 days.

Financial records may be retained longer where required by applicable law.

Security

We implement industry-standard security measures including encryption in transit (TLS 1.2+), encryption at rest (AES-256), role-based access controls, and enforced multi-factor authentication for board and manager accounts.

No system is completely immune from breach. We will notify affected users and regulators of any confirmed data breach as required by applicable law within 72 hours of becoming aware.

Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate or incomplete data
  • Request deletion of your data ("right to be forgotten")
  • Object to or restrict certain processing
  • Data portability — receive your data in a structured, machine-readable format
  • Withdraw consent at any time where processing is based on consent
  • Lodge a complaint with a supervisory authority

Cookies

We use strictly necessary cookies to maintain session state and keep you logged in. We use analytics cookies to understand how the product is used and improve it. You can disable non-essential cookies in your browser settings or by contacting us.

We do not serve advertising cookies or share cookie data with ad networks.

Children's Privacy

The Services are not directed to individuals under 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with their information, contact us immediately and we will delete it.

Changes to This Policy

We may update this policy periodically. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the updated policy.
